New York has been able to fight off coronavirus recently. It was far slower than most of the other states in the United States in case of reopening. However, it seems that the decision has paid off. New York, once the hardest-hit state in the country now comes in the list of one of the safest states in America. 

The state has been following a very systematic approach in terms of reopening. Even though the new cases are continuously flattening, it is showing no signs of a hurry. It is a reopening state in a phase-wise manner. Recently the state entered the phase of 4 of reopening that saw many other businesses reopening that were closed previously. 

However, to the shock of the gym owners, gyms have been left out of the reopening plan. Gym owners are not happy with the decision at all.

Coming together, they have filed a class-action suit against Governor Cuomo, the general office of the state’s attorney and the State itself. The attorney representing them has said that the state needs to pay the gym owners if they are to remain closed.

The attorney said that “Basically, they’re taking away our clients’ livelihood, our clients’ business, for public use or public purpose, which is, according to the governor, to stop the spread of COVID,” Therefore, pay these people. Pay the gym owners, because how are they supposed to survive?” 

“We’re looking to open up the gyms and to rule that the continuation of this executive order is unconstitutional,” he said. “We’re not arguing that when Cuomo put the executive orders in place, he had emergency powers. He had the right to do that. Now, we feel the emergency is over, at least here in New York, where we can strike a balance and let people earn a living.” 

Now it remains to be seen what decision the state takes. Because the claims of the gym owners are not invalid either. They are continuously incurring rent and other fixed expenses. Moreover, there is no phase 5 of reopening either. So, gym owners are left in uncertainty as of now. 

Gyms were left out of phase 4 reopening plan after it was considered that the air conditioning system present could be a vehicle for virus transmission. For more such latest news stay tuned with us.
